DESTINATION DISCOVERED TRAVEL WRITER CONTEST RULES
Eligibility
NO PURCHASE NECESSARY. Contest is open to residents of North America (Entrant) 18 years of age or older. Employees of Destination Hotels & Resorts, its advertising and promotional agencies or Lowe Enterprises, and their immediate families are not eligible to enter or win.
Entries
To enter, Entrant must FILL OUT ENTRY FORM COMPLETELY, including an original essay of up to 200 words explaining their desire to experience the life of a travel writer. Sponsor reserves the right to disqualify any submission at any time in the event it is determined that the submission is offensive, inappropriate, not in keeping with Sponsor's image, or if it is determined that the Entrant has not otherwise complied with these Official Rules.
ALTERNATIVE ENTRY: Mail a 3 x 5 postcard (postage prepaid) containing the Entrant’s full name, postal address, email address (or a statement that the Entrant does not have an email address), a statement that the Entrant has read and agrees to these rules, the 200 word essay and a telephone number (including area code) where the Entrant can be reached or where a message can be left between the hours of 10:00 a.m. and 4:00 p.m. Mountain Standard Time during the Sweepstakes period, to the following address:

Winner will be notified on August 1, 2010. Non-winners will be notified by August 15, 2010. Travel dates will be provided to each set of winners at time of winner selection notification. Contest may be terminated at any time without notice.
Terms and Conditions
By claiming a prize, winner agrees that the Sponsor, affiliates and advertising and promotional agencies, do not have any liability whatsoever for any injuries, losses or damages of any kind related to participation in this Contest, or from acceptance or use of the prize.
By entering, winner grants the Sponsor the right to edit, adapt, and publish any or all images and written material submitted, and to use these materials in any media form, including posting on the Internet, including, but not limited to DestinationDelivers.com, DestinationHotels.com or any of the participating Destination Hotels & Resorts-managed properties’ websites, in any manner of Sponsor's choice without attribution or further compensation.
Acceptance of the prize shall constitute the winner's agreement that the Sponsor or their agent(s) may use and/or display the winner's name, address (city, state only), likeness, biographical information, images and all or any portion of their written submitted material, without limitation, for promotional purposes, without further consideration, except where prohibited by law.
Judging
Winners will be chosen by the judgment of the Sponsor or their agents, which will be final. Should a winner be disqualified for any reason, the Sponsor reserves the right to choose an alternate winner, either by using the same judging criteria or at random.
Selection of winner will be made at AIR Marketing, 3419 East University Drive, Phoenix, AZ 85034 on August 1, 2010. Winners will be notified not later than August 1, 2010. Prizes will be distributed not later than September 30, 2010, except as otherwise stated in these Sweepstakes rules. The odds of winning will be determined by the total number of eligible entries received. The winner will be notified by telephone and/or by email. All prizes will be awarded. Prizes are non-transferable, non-negotiable and not redeemable for cash, credit or merchandise. If any prize becomes unavailable for any reason, Destination Hotels and Resorts, Inc. reserves the right to substitute a prize of comparable value. Entrants agree that Destination Hotels and Resorts, Inc. has the sole right to decide all matters and disputes arising from this promotion and that a decision by Destination Hotels and Resorts, Inc. is final and binding. A list of winners may be obtained for a period of four (4) years after the date of the drawing by mailing a written request and a self-addressed, stamped envelope to Destination Hotels and Resorts, Inc., 10333 East Dry Creek Road, Suite 450, Englewood, Colorado 80112.
Prizes
The contest period runs from July 1, 2010 through July 31, 2010. Prizes are as follows:
One winner will be drawn at random to receive the Grand Prize of:
- Accommodations for 2 people at Miramonte Resort & Spa for two nights
- Rental car for three days
- Access to premium experiences as determined by Miramonte Resort & Spa
- Use of resort-owned camera and video equipment, which must be returned in perfect condition upon completion of stay
Prize Restrictions
If the prize winner does not have the opportunity to go on the trip for any reason whatsoever, then no compensation or alternate prize will be awarded. Travel dates will be determined by Sponsor and are based upon resort availability. Trip will take place no later than September 31, 2010.
Additional fees over and above base daily rental rate for the rental car are the sole responsibility of the winner.
The Grand Prize winner’s travel companions must be 18 years of age or older, or if any companion is a minor, the winner must be such minor’s parent or legal guardian and each such companion (or such minor companion’s parent or legal guardian) must sign and return a liability/publicity release prior to ticketing air travel. The Grand Prize winner and his or her travel companions must travel on the same itinerary and possess all required travel documents and state or U.S. government-issued identification.
Prize Distribution
All taxes on prizes (if applicable) are the sole responsibility of the winner. Prizes are not transferable/assignable. No cash alternative to prize is offered and no substitutions are allowed, except at the sole discretion of Sponsor.
Releases
If an image contains any material or elements that are not owned by the Entrant and/or which are subject to the rights of third parties, and/or if any persons appear in the photograph, the Entrant is responsible for obtaining, prior to submission of the photograph, any and all releases and consents necessary to permit the exhibition and use of the image in the manner set forth in these Official Rules without additional compensation. If any person appearing in any image is under the age of majority in their state/province/territory of residence the signature of a parent or legal guardian is required on each release.
If the submission contains any material or elements that are not owned by the Entrant and/or which are subject to the rights of third parties, the Entrant is responsible for obtaining, prior to submission of the photo, any and all releases and consents necessary to permit the use and exhibition of the submission by Sponsor.
Entrants Consent To Receive Email Marketing
By entering the Sweepstakes, Entrants are agreeing to receive email offers from Destination Hotels and Resorts, Inc., its subsidiaries and its affiliates, together offers from the entities that own or control the properties that any of them manage from time to time.
Disclaimers
None of Destination Hotels and Resorts, Inc., E-site Marketing, L.L.C., AIR Marketing or any of their respective parents, subsidiaries or affiliates, participating destinations and partners are responsible for errors in printing or electronic presentation of the Sweepstakes. If for any reason the Sweepstakes are not capable of running as planned on any website, including infection by a computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of any of the foregoing entities which corrupt and affect the administration, secrecy, fairness, integrity or proper conduct of the Sweepstakes, Destination Hotels and Resorts, Inc. further reserves the right to cancel, terminate or modify the Sweepstakes. Entries that are lost, late, misdirected, incorrect, garbled, or incompletely received, for any reason, including by reason of hardware, software, browser, or network failure, malfunction, congestion, or incompatibility of any servers or elsewhere, will not be eligible. Destination Hotels and Resorts, Inc., in its sole discretion, reserves the right to disqualify any person tampering with the entry process or the operation of the website. Use of “bots” or other automated process to enter is prohibited and may result in disqualification at the sole discretion of Destination Hotels and Resorts, Inc. In the event of a dispute regarding on-line entry, the entry will be deemed submitted by the authorized holder of the email account submitted at the time of entry. Authorized account holder is defined as the natural person who is assigned to an email address by the Internet access provider, on-line service provider or other organization that is responsible for arranging email address for the domain associated with the submitted email address. Rules are subject to any requirements/limitations imposed by the FCC. All Federal, State and local laws and regulations apply.
Indemnification and Limitations of Liability
Winner and travel companions, by acceptance of the prize, agree to release, indemnify and hold harmless Destination Hotels and Resorts, Inc., E-site Marketing, AIR Marketing and their respective parent, subsidiary and affiliate entities, participating destinations and other participating partners in the promotion, and each of their employees, officers, directors, representatives, contractors, sponsors and advertisers, from any and all liability, injuries (including without limitation emotional distress or death), loss, damage, costs or claims related to any allegation regarding the award of, the receipt of, or the use of their prize. Destination Hotels and Resorts, Inc., E-site Marketing, AIR Marketing, and their respective parents, subsidiaries and affiliates, participating destinations and other participating partners in the promotion, and each of their employees, officers, directors, representatives, contractors, sponsors and advertisers are not responsible for personal injury (including without limitation emotional distress or death) or property loss or damage of any prize winner or travel companion incurred in connection with the use of any prize. Winner assumes all applicable tax liability for his or her prize.
Governing Law and Mandatory Arbitration
These Sweepstakes rules shall be interpreted pursuant to the federal laws of the United States and the laws of the State of California to the extent not in conflict therewith without regard to any provisions of California law that would require the application of the laws of another jurisdiction. Any dispute or controversy arising out of or concerning the Sweepstakes shall be fully and finally adjudicated by binding arbitration before a single arbitrator in Los Angeles, California under the Commercial Rules of the American Arbitration Association (available at http://www.adr.org). The arbitrator’s fee shall be split evenly among the parties. Each party shall pay for his, her or its attorneys’ fees, experts’ fees and other costs. The decision of the arbitrator shall be final and binding on the parties and may not be vacated or modified except to the extent permitted by the Federal Arbitration Act. The arbitrator shall issue written findings of fact and conclusions of law within thirty (30) days after conclusion of the arbitration. The arbitrator shall not have the power to award punitive, exemplary or consequential damages of any kind or in any amount. Discovery by oral deposition under oath, production of documents and admission of facts shall be permitted. Judgment may be entered on the arbitration award in any court having jurisdiction.

The Destination Delivers Sweepstakes (the "Promotion") officially starts at 12:00 AM Pacific Time ("PT") on July 1, 2010, and ends at 11:59 PM PT on October 31, 2010 (the "Promotion Period"). Entries received prior or subsequent to such times will be invalid for this Promotion. Pacific Time shall control for all purpose of this Promotion.
PRIZES: Major restrictions may apply to the use, availability, or receipt of a Prize ("Prize"). Winning a Prize is based solely on chance. No Prize substitutions will be made at the request of a Prize winner. The Promoter and Sponsor reserve the right, however, to substitute a Prize of equal or greater value in the event the Prize cannot be awarded as described. Prizes are not transferable. All currencies within these Official Rules are in U.S. dollars.
Winners of the Promotion will be notified by email only. If selected as a winner, a notification email will be sent to the current email address on record for the Destination Delivers Member approximately fifteen (15) business days after the drawing. If the potential winner fails to respond to such email within five (5) days of it being sent, such winner will be disqualified and an alternate winner will be randomly selected from the remaining eligible entries. The Promoter and Sponsor are not responsible for notification failure due to inaccuracy in your email address or any other failure or problem of any kind related to notification. If notification is returned as non-deliverable, or if a winner is found to be ineligible or not in compliance with these Official Rules, the winner will be disqualified.You are solely responsible for keeping your email address and other contact information current with the Website.
Except where prohibited by law, acceptance of a Prize constitutes permission for the Promoter and Sponsor to use your name, city and state of residence, photographs, picture, portrait or other likenesses, voice, testimonials, biographical information (in whole or in part), and/or statements regarding this Promotion for editorial, public relations, promotional, and advertising purposes in all media now known or hereafter discovered, worldwide, including but not limited to the World Wide Web, newspapers and other print media, radio, and television, without notice, review, or approval, on behalf of the Promoters and Sponsors and without compensation. Winners may be required to provide their first and last names, complete home mailing addresses (no P.O. boxes), daytime telephone numbers (including area code), and dates of birth.
Winners may be required to sign and have notarized Affidavits of Eligibility and Release of Liability, Publicity Releases, and any other legal documents which Sponsors may require, including a W-9 tax form, unless prohibited by law, within fourteen (14) days of receipt and prior to accepting the Prize. Winners shall be responsible for all Prize expenses and taxes related to acceptance, including, but not limited to, all federal, state, and local taxes and all incidental expenses. All expenses not specifically included in the Prize are winners’ sole responsibility. Winners will be sent an IRS Federal 1099-MISC tax form for the retail value of the Prize they have won. If a potential winner cannot be contacted, fails to claim Prize, fails to comply with all rules, fails to respond to the winner notification, or fails to fulfill the Affidavit-related obligations, the selected winner shall be disqualified, the Prize forfeited, and a new winner will be randomly selected from the remaining eligible Destination Delivers Members.
By accepting a Prize, each winner agrees to release, discharge, indemnify, and agree to defend and hold harmless the Promoter, Sponsor, John DeMarco/Lowe Enterprises, their respective advertising and promotion agencies, and all of their respective parents, affiliates, subsidiaries, agencies, agents, and representatives, and all of their respective employees, officers, and directors from any and all claims, costs, injuries, losses, or damages of any kind (including, without limitation, claims, costs, injuries, losses, and damages related to personal injuries, death, damage to, loss or destruction of property, rights of publicity or privacy, defamation, or portrayal in a false light), arising out of or in connection with the Promotion or from winner’s acceptance, possession, use, or misuse of any Prize, or participation in the Promotion or any Promotion related activity. In no event will the Promoter, the Sponsor, John DeMarco/Lowe Enterprises, or any of their affiliates, or their respective officers, directors, employees, representatives, and agents be responsible or liable for any damages or losses of any kind, whether direct, indirect, incidental, consequential, punitive, or other damages. By participating in the Promotion you acknowledge that the Promoter, Sponsor, and John DeMarco/Lowe Enterprises have neither made nor are in any manner responsible or liable for any warranty, representations, or guarantees, express or implied, in fact or in law, relative to any Prize.
The Promoter reserves the right, in its sole and absolute discretion, to suspend or cancel this Promotion, or any portion thereof, should computer hardware or software malfunctions (such as but not limited to virus, bugs, worms, tampering, unauthorized intervention, fraud, or technical failures) or any other causes corrupt the administration, security, or proper play of the Promotion, and select winners from entries received prior to the action taken or in such other manner as deemed fair and appropriate by Promoter. Any attempt by an entrant or any other individual to undermine the legitimate operation of the Promotion may be in violation of criminal and civil laws and should such an attempt be made, the Promoter reserves the right to seek damages and other remedies from any such person to the fullest extent permitted by law, including criminal prosecution. The Promoter’s failure to enforce any term of these Official Rules shall not constitute a waiver of that or any other provision. The Promoter reserves the right to disqualify anyone who violates the rules or interferes with this Promotion in any manner.
The Promoter and Sponsor are not responsible for any typographical or other error in the printing of this offer, administration of the Promotion, or in the announcement of any Prizes, including such error as may give an erroneous indication that a Prize has been won. In the event the Promoter or Sponsor is prevented from continuing with this Promotion, or the integrity and/or feasibility of the Promotion is undermined by any event including but not limited to flood, fire, earthquake, epidemic, explosion, labor dispute or strike, act of God or public enemy, satellite or equipment failure, riot or civil disturbance, war (declared or undeclared), terrorist threat or activity, or any federal, state, or local government law, order or regulation, order of any court or jurisdiction, or other cause not reasonably within the Promoter’s or Sponsor’s control (each a “Force Majeure” event), the Promoter shall have the right, in its sole discretion, to abbreviate, modify, suspend, cancel or terminate the Promotion without notice or further obligation. If the Promoter, in its discretion, elects to abbreviate the Promotion as a result of a Force Majeure event, the Promoter reserves the right, but shall have no obligation, to award the Prizes from among all valid and eligible entries received up to the time of such Force Majeure event.
Except where prohibited, you agree that: (1) any and all disputes, claims, and causes of action arising out of or connected with this Promotion, or any Prize awarded, or the determination of the winners, shall be resolved individually, without resort to any form of class action, and exclusively by arbitration pursuant to the Rules of the American Arbitration Association, then effective; and (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, but shall in no event include attorneys’ fees; and (3) under no circumstances will you be permitted to obtain awards for, and you hereby waive all rights to claim, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased.
